I have always been interested in the stories of Scottish women.

Anyone looking for women`s stories in our historical record will, of course, encounter the witch trials, as around 85% of Scotland`s accused witches were women. The Witchcraft Act was an Act of the Scottish Parliament on 4 June 1563. It has adopted a framework under which a person can be charged with witchcraft, tried and executed if convicted. The Witchcraft Act of 1735 (9 Geo. 2 c. 5) marked a complete reversal of attitudes. Punishments for the practice of witchcraft, as it was traditionally constituted, which at the time was considered an impossible crime by many influential figures, were replaced by punishments for the pretext of witchcraft. A person who claimed to have the power to summon spirits or predict the future, cast spells or discover the whereabouts of stolen property were to be punished as a tramp and a fraudster punishable by fines and imprisonment. The Act applied throughout Great Britain and repealed both the Scottish Act of 1563 and the English Act of 1604. [7] The Witchcraft Act 1603 was applied in the Anglo-American colonies, for example in the trial of Margaret Mattson, a woman accused of witchcraft in the province of Pennsylvania. (She was acquitted by William Penn in 1683 after a trial in Philadelphia.) In the eighteenth century, authorities were increasingly skeptical of witchcraft, and prosecutions were less likely to lead to executions.

Religious tensions in England during the 16th and 17th centuries led to the introduction of harsh penalties for witchcraft. Henry VIII`s Act of 1541[1] (33 Hen. VIII century 8) was the first to define witchcraft as a crime, a crime punishable by death and confiscation of property and movable property. [2] It was forbidden: the Witchcraft Act, which criminalized witchcraft, was repealed by the British Parliament in 1736, which is mainly an English initiative, and then he says: “Oh, there is a Witchcraft Act in Scotland too, let`s repeal this”. After that, no one can be executed. A law of 1562[1] against incantations, enchantments and witchcraft (5 Eliz. I c. 16) was adopted at the beginning of the reign of Elizabeth I. The law stated that anyone who “used, practiced or practiced witchcraft, enchantment, spells or witchcraft, thereby killing or destroying any person” was guilty of a crime of no benefit to the clergy and should be killed. They are not so interested in the divine right of kings, so the government does not try to prove their divine legitimacy. It`s just getting old-fashioned.

There are more modern scientific ideas that do not necessarily contradict witchcraft, but only marginalize it, and so the excitement comes out of it. People lose interest in it and it gradually fades. The last known witch to have been executed was in 1727. The first very big panic is sometimes called the “North Berwick panic”. He was associated with King James VI in 1590, 1591. Some of the witches are said to have conspired against the king. And they are said to have held a meeting at North Berwick Church on Halloween 1590, where she got her name. The witches came from different places – Edinburgh and different places in East Lothian. The king`s involvement politicizes witchcraft and you get several panics afterwards. The last really big one is 1661, `62.

For the next half century, you have a little panic. Scottish lawyer and adviser to King Claire Mitchell, who launched The Witches of Scotland campaign, said: “Those convicted of witchcraft have been strangled and burned at the stake so as not to bury a body.” Under the Scottish Witchcraft Act of 1563, the practice of witchcraft and counseling witches were capital crimes. [7] This Act remained in the books of Scottish law until it was repealed following an amendment by the House of Lords to the Post-Union Witchcraft Bill 1735. [8] [9] But if the authorities are interested in executing witches, you know, witches are appointed by the authorities. And the authorities` own ideas about witchcraft come into play. They tend to assume that a witch is someone who makes a pact with the devil, who sells her soul to the devil, if you will. This was at a time in Scotland when reformers were trying to enshrine the Protestant faith in law. In 1560, Parliament had begun to do so, but without royal approval. The leaders of the new church intended to pass laws that would make Scotland a “God-fearing” country that would punish a whole host of “Horibill vices” such as witchcraft, adultery, etc.

Will the Us Ever Legalize Prostitution

The debate is undoubtedly polarizing in many quarters, even among advocates for trafficked and sexually abused women, who fear that creating a legal pathway for prostitution will not eradicate illegal sex trafficking, but will even encourage it. Everyone deserves access to financial services and everyone should be able to earn a living, including sex workers. An Amnesty International report notes that sex workers in Norway are regularly evicted from their homes because landlords fear that leases will sue them for encouraging sex. Similar accountability concerns discourage third parties, such as security forces, from also working with sex workers. As a result, sex workers themselves may not be prosecuted, but their lives are no less secure or more rooted in society. The legalization of prostitution does not prevent the violence and rape inherent in prostitution. He agrees. “Indeed, rape is the defining experience of prostitution: the fear of it, the daily hypervigilance necessary to prevent it, the overwhelming physical and psychological trauma that victims suffer when it inevitably occurs.” See: Lisa Thompson, “Prostitutes and Sex Trafficked Are Also Victims of Rape” (April 19, 2016)) However, he also noted that “the number of sex workers and minors does not appear to have changed significantly due to decriminalization.” In 1908, the government created the Bureau of Investigation (BOI, from 1935 the FBI) to investigate “white slavery” by interviewing brothel employees to find out if they had been kidnapped. Of the 1,106 prostitutes surveyed in one city, six said they had been victims of white slavery. The White-Slave Traffic Act (Mann Act) of 1910 outlawed so-called white slavery. It also banned the interstate transportation of women for “immoral purposes.” Its stated primary intention was to tackle prostitution and perceived immorality.

The Supreme Court later considered consensual debauchery, adultery and polygamy to be “immoral ends.” Before World War I, there were few laws criminalizing prostitutes or prostitution. [6] Although prostitution is mistakenly called the oldest profession in the world, it is on the minds of legislators as long as existing laws allow us to pursue it. The Code of Hammurabi, the most comprehensive of the ancient Babylonian laws, does not deal directly with sex trafficking, but distinguishes between inheritance rights enjoyed by “devoted women” and prostituted women. Nevada, in particular, has become a focal point of this debate, as it is the only state to continually legalize prostitution — which, critics say, has led to human trafficking. NCOSE and the alleged survivors sued the state last year, saying it was not complying with the 13th Amendment, which was originally intended to end slavery. In jurisdictions where prostitution is illegal, prostitution is aggressively promoted as a tourist attraction. “What happens in Vegas stays in Vegas” or some other cute marketing slogan is used to celebrate vice at the expense of countless victims. This has been exacerbated since the NHL and NFL moved professional sports teams to southern Nevada. Las Vegas` legal brothels and black market vendors have positioned themselves to take advantage of tourists from all over the country for a “good time.” But this attitude – “not really human trafficking” – sounds like intentional, ethically lazy or extremely naïve ignorance. Yes, victims of sex worker trafficking need social services, but they also need laws, not ideals, to protect them.

You cannot free yourself from human trafficking. Proponents of full decriminalization hope that such laws will facilitate freedom of choice, access to social services, improved health and working conditions, and the decoupling of the profession from criminal enterprises. They also argue that full decriminalization eliminates the unintended consequences of the equality model. Yet some advocates of trafficking and sexual abuse of women in New York and elsewhere call these efforts misguided. They believe that full decriminalization will create a demand that will be met by more women. Many gender equality advocates agree that decriminalizing those engaged in sex work will help them access health services and keep them safe. Sex workers are often afraid to contact law enforcement about possible criminal charges and jail time, as well as possible mistreatment by public officials. Some did not seek treatment because of stigma or fear of losing their children. In most cases, the act of prostitution should be considered sex trafficking, as exchanging money (or something of value) to obtain a sexual act is an act of sexual assault.

Survivors who worked in legal and illegal prostitution described their experiences with prostitution as “paid rape,” “pay-as-you-go rape,” and “rape for a living.” See: Rachel Moran, Paid for: My Journey Through Prostitution 112-113 (2013).) But the Urban Justice Center argues that prostitution, pornography and other forms of “sex work” provide valuable sources of income for many. However, social and economic pressures are usually what proponents, on the other hand, see as justification for liberalizing prostitution laws. Although informal, red-light districts can be found in some parts of the country. Since prostitution is illegal, there are no official brothels, but massage parlors offering prostitution can be found with street prostitution. Typically, these areas also have other adult-oriented businesses, often due to zoning, such as strip clubs, sex shops, adult cinemas, adult video arcades, peep shows, sex shows, and sex clubs. Potter, the district`s deputy DA, included an amnesty for sex workers as part of his successful campaign. [55] Some New York District Attorneys have declared support for the Nordic model, but this has elicited backlash from sex worker advocates who oppose lawsuits against buyers. [56] This year, a bill was introduced in the Oregon Legislature that would repeal the criminalization of prostitution and commercial sexual solicitation for the buyer and seller of sexual services. In Maine, a bill introduced this year proposed only partial decriminalization of prostitution — as opposed to full decriminalization, it would still have exposed people who pay for sex to legal consequences. Child prostitution in the United States is a serious problem. [38] [39] More than 100,000 children are estimated to be forced into prostitution each year in the United States. [40] [41] The May Law, which came into effect in June 1941, aimed to prevent prostitution in restricted areas around military bases. He was called up mainly during the war.

Why Should Death Penalty Be Legalized in the Philippines

When Amnesty International began its work in 1977, only 16 countries had completely abolished the death penalty. Today, there are 106, more than half of the world`s countries. More than two-thirds are abolitionist in law or practice. Lawmakers urged their colleagues to focus on tackling the root causes of crime and drug use, rather than pushing for a reinstatement of the death penalty. They also stressed the need to give priority to the reform of key institutions of the criminal justice system, including the police and the judiciary. Amnesty International believes that the death penalty violates human rights, in particular the right to life and the right to live free from torture or cruel, inhuman or degrading treatment or punishment. Both rights are protected by the Universal Declaration of Human Rights adopted by the United Nations in 1948. Today, in its third and final reading, the Philippine House of Representatives passed Bill 4727, a measure proposed by President Rodrigo Duterte`s majority coalition to reinstate the death penalty. Lawmakers noted that the law, if passed and signed, would violate the Philippines` international legal obligations under the Second Optional Protocol to the International Covenant on Civil and Political Rights (ICCPR), which the country ratified in 2007 and is committed to permanently abolishing the death penalty within its borders. But President Gloria Macapagal-Arroyo abolished the death penalty in 2006 under pressure from the Catholic Church. Human Rights Watch opposes the death penalty in all circumstances because it is inherently cruel and irreversible. The use of the death penalty for crimes committed by persons under the age of 18 is prohibited under international human rights law, but some countries continue to sentence and execute juvenile defendants.

Countries parties to the Covenant and Protocol cannot reintroduce the death penalty without violating their obligations under international human rights law. This would probably lead to more than worrying statements from foreign trading partners such as the European Union. However, after his election in May 2016, the new president, Rodrigo Duterte, publicly spoke out in favor of reinstating the death penalty. On March 7, 2017, the House of Representatives voted overwhelmingly in favor of a bill. Senators, including PGA members, spoke out against efforts to reinstate the death penalty and successfully blocked the passage of the law. The Philippines ratified the 1986 International Covenant on Civil and Political Rights (ICCPR) and its Second Optional Protocol concerning the abolition of the death penalty (ICCPR-OP2) in 2007. This deters bad people from committing heinous crimes. One of the reasons why the death penalty is in favour of the death penalty is its effectiveness as a deterrent to crime.

According to supporters of the death penalty, potential criminals will be afraid of such harsh punishments and, therefore, they will be reluctant to commit crimes such as rape and murder. The burden of the death penalty is disproportionately borne by persons from a disadvantaged socio-economic background or belonging to a racial, ethnic or religious minority. This includes, for example, having limited access to legal aid or being at a greater disadvantage in their experience with the criminal justice system. “There is no other solution: the reinstatement of the death penalty means a new offensive in the Philippine war against the poor. Today, we call on the Philippine Senate to reject all proposals to reinstate the death penalty. Ask our senators to recognize that the death penalty does not deter all forms of crime and contributes to a culture that constantly devalues life. Republic Act No. 7659 provides that a criminal convicted of a heinous crime through due process must be executed. This law protects the accused, guilty or not, in order to have the freedom to testify and prove his innocence. When deciding on an offender`s case, particular attention is paid to this point before the death penalty is imposed. The Supreme Court`s decision cannot be made immediately, as many factors must prove whether the man is guilty and deserves the death penalty. Amnesty International rejects the death penalty for all crimes and in all circumstances.

Why Is Income Tax Legal

The argument that a person`s income will not be taxed if he or she rejects or renounces U.S. citizenship because he or she claims to be exclusively a citizen of a state, and variations of that argument, have been officially identified as legally frivolous federal tax return items for purposes of the frivolous $5,000 tax return penalty imposed under Section 6702(a) of the Internal Revenue Code. [17] Overall, most Americans thought the new tax was a great idea. One taxpayer wrote to the Bureau of Internal Revenue: “I have intentionally omitted certain deductions that I might claim in order to have the privilege and pleasure of paying at least a small income tax.” Nevertheless, about 60 years later, the first income tax was levied in the United States to pay for the Civil War. At the end of the conflict, this tax was repealed, but it gave the federal government a taste of the revenue that income tax could generate. A new income tax was introduced in 1894, ostensibly to compensate for the loss of revenue due to reduced U.S. tariffs. The audience was not impressed. This tax was taken to the Supreme Court and declared unconstitutional in Pollock v. Farmers` Loan and Trust Co. Proponents of this demand argue that African Americans can claim a so-called “black tax credit” on their federal tax returns in compensation for slavery and other oppressive treatment of African Americans. A similar frivolous argument has been made that Native Americans are entitled to a credit on their tax returns as a form of redress for past repressive treatment.

The law: There is no provision in the Internal Revenue Code that allows taxpayers to claim a “Black Tax Credit” or an Indian Reparations Credit. It is a well-established legal principle that deductions and offsets are a matter of legislative pardon. See INDOPCO, Inc. v. Commissioner, 503 U.S. 79, 84 (1992); New Colonial Ice Co. v. Helvering, 292 U.S. 435, 440 (1934). Except as expressly provided in the Internal Revenue Code, no deductions or credits are permitted. The IRS warned taxpayers of the consequences of seeking refunds or other tax benefits based on frivolous tax credits.

In 609, the IRS warned taxpayers against the frivolous nature of seeking exemption for Native Americans from federal income tax on the basis of an unspecified “Indian contract.” rEV.rUL. 2004-1C.B. Individuals who seek or assist others in obtaining refunds based on the Slavery Compensation Tax Credit will be prosecuted for violating federal tax laws. In addition, the United States has an injunction against a party suspected of violating tax laws. In such cases, Articles 7407 and 7408 provide for injunctive relief against taxpayers or promoters of abusive tax havens. Relevant case law: The income tax amendment, which has a considerable social and economic impact, was incorporated into the Constitution following a curious series of events that culminated in some political manoeuvring gone wrong. To counter the defeat, the administration drafted the 16th Amendment, which states that “Congress has the power to levy and levy taxes on income, from any source, without division among any state and without regard to a census or census.” The amendment was ratified in 1913 and removed legal obstacles to the establishment of an income tax. Supreme Court`s decision in Eisner v. Macomber[113] for the theory that wages are not taxable,[114] or for the theory that dividends are not taxable. With such a “dividend”, the shareholder receives nothing and does not realize any added value. For example, if a shareholder owns 100 shares worth $4 per share, the total value is $400. This material, which is supposed to be a quotation, does not appear at all in the text of the case. Moreover, the words “wages” and “salaries” do not appear anywhere in the text, and there is no ruling in this case that federal income tax laws apply only to “businesses.” The Colonial Pipeline case was actually about Louisiana`s corporate income tax, not a federal tax. The validity of the Louisiana franchise tax in this case was upheld by the U.S. Supreme Court. In the case of the Colonial Pipeline, no issue related to the validity or applicability of federal income tax was raised, mentioned or decided by the Supreme Court.

As mentioned earlier, taxation is mandatory, not voluntary. Some people claim that compulsory taxation is a form of slavery and therefore illegal. They cite the 13th Amendment, which prohibits slavery in the United States. In 1894, Congress enacted a 2% tax on income over $4,000 as part of a high tariff law. The tax was repealed almost immediately by a five-to-four Supreme Court decision, although the court did not uphold the constitutionality of the Civil War tax until 1881. Although agricultural organizations condemned the court`s decision as an excellent example of the alliance of state and business against peasants, a general return to prosperity at the turn of the century tempered the demand for reform. However, Democratic Party platforms, led by three-time presidential candidate William Jennings Bryan, systematically included an income tax plan, and the progressive wing of the Republican Party also supported the concept. The financial demands of the Civil War led to the first U.S. income tax in 1861. At first, Congress imposed a flat 3% tax on all income over $800, then changed that principle to include a progressive tax.

Congress repealed the income tax in 1872, but the concept has not disappeared. More directly, there was no “sale or other sale” of the shares. The taxpayer always owns the same asset (i.e. The same interest in the company that he held before the stock dividend. Even if his base amount (usually the amount he originally paid for the stock) is less than $400 (i.e., even if he has an unrealized or potential gain), he has not yet “realized” the gain. The court ruled that this type of stock dividend is not treated as “income” for a shareholder.
